Terms of Service
These Terms of Service ("Terms") apply to the games, apps and services provided by Peña Chávez Engineering and Extended Reality LLC ("PCEXR", "we", "us") and its game studio, Sick 455 Fus Game Studios, including ZombieStuff for Meta Quest, and to this website (together, the "Services"). Sick 455 Fus Game Studios is a studio of PCEXR; games published under the Sick 455 Fus Game Studios name are provided by PCEXR, and references to "we" or "us" include Sick 455 Fus Game Studios. By downloading, installing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Meta Horizon Store
Our apps are distributed through the Meta Horizon Store. Your purchase, download, payment and any refunds are also governed by Meta's terms and policies. If these Terms conflict with Meta's terms for a store purchase, Meta's terms control for that purchase.
2. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use our apps for your personal, non-commercial entertainment on devices you own or control. You do not own the app; you are licensed to use it.
3. Restrictions
You agree not to:
- Copy, modify, distribute, sell or rent the Services, except as allowed by law
- Reverse engineer, decompile or disassemble the Services, except as allowed by law
- Use cheats, exploits or unauthorized software that alter the Services
- Use the Services in a way that breaks the law or harms others
4. Intellectual property
The Services and their content, including code, artwork, audio, characters, names and logos, are owned by PCEXR (including Sick 455 Fus Game Studios) or its licensors and are protected by intellectual property laws. All rights not expressly granted to you are reserved.
5. Health and safety
Virtual reality can cause motion sickness, disorientation, eye strain, and injuries from collisions with objects or people. Read and follow your headset manufacturer's health and safety warnings, play in a clear space, take regular breaks, and stop immediately if you feel unwell. Adults should supervise younger players and follow the headset's minimum age requirements. You use the Services at your own risk.
6. Updates and changes
We may update, change or discontinue any part of the Services at any time. Some updates may be required to keep using the app.
7. Disclaimer of warranties
To the fullest extent allowed by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free.
8. Limitation of liability
To the fullest extent allowed by law, PCEXR will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid for the app that gave rise to the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.
9. Termination
Your license ends automatically if you break these Terms. You may stop using the Services at any time by uninstalling the app.
10. Privacy
Our Privacy Policy explains how we handle information. It is part of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date above. Continuing to use the Services after an update means you accept the updated Terms.
